Update of the EU Control List of Dual-Use Items

On 20 October 2021, the European Commission adopted the annual Delegated Regulation that updates the EU dual-use export control list in Annex I to Regulation (EU) 2021/821.


This brings it in line with the decisions taken within the framework of the international non-proliferation regimes and export control arrangements until December 2020. The updated control list includes a new note for the control of biocontainment chambers, isolators, or biological safety cabinets (2B352.f.2 Note 2) in order to include any isolator meeting all of the mentioned characteristics in the description of the item, regardless of its intended use and its designation. The updated control lists also makes a change to the definition of "superalloys", in order to specify the ultimate tensile strength of such materials. The new definition is as follows: o "Superalloys" (2 9) means nickel , cobalt or iron base alloys having a stress rupture life greater than 1 000 hours at 400 MPa and an ultimate tensile strength greater than 850 MPa, at 922 K (649oC) or higher. Other changes were mostly editorial, and correction of minor errors. Subject to the Council and the European Parliament raising no objections within a period of 2 months, the Commission Delegated Regulation (Ref. C(2021)7424) will be published and will enter into force on the day following that of its publication. Source: European Commission
